Responsabilidade jurídica em casos de insucesso do implante: revisão sistemática

Abstract
Introduction: With the advancement of Implantology in recent years, it is possible to observe a significant increase not only in the number of patients who seek this treatment alternative, but we can also notice the growth of professionals who qualify to perform such procedures. However, Implantology is not free of complications and failures, which can lead to legal discussions between patients and these. Objectives: This article aims to present some of the occurrences that can lead to the failure of dental implants, as well as the possible legal consequences that can affect the dentist and the necessary knowledge to minimize the damage, material and moral, arising from complications arising from improper treatments or with failure in their routines, through a systematic review. Methods: To prepare this article, searches were carried out on several sites, including Google Scholar, Virtual Health Library (Bireme), Scientific Electronic Library Online (Scielo), LILACS, BVS (Virtual Health Library), and PubMED/Medline. Complete articles, guidelines, protocols, monographs, theses and dissertations published in full were selected, publications in Portuguese and English being accepted. For the searches, the keywords were used: Dental Implant; Civil responsability; Dental Legislation; Forensic Dentistry and Failures. Legal decisions were also analyzed on the JusBrasil website, on the websites of the Courts of Justice of Minas Gerais and Rio de Janeiro in second instances, using the term dental implant. Results: 47 processes were identified in the TJRJ and 115 processes in the TJMG, where acquittals and convictions of dentists were observed, where the dental documentation, consisting of the terms of consent, complementary exams and 5 medical records, proved to be of vital importance for the decision of the cases in the legal sphere. Conclusion: Based on the data and information collected, it was possible to conclude that Implantology is not a treatment alternative free of complications and failures, being the duty of the implantodontist to duly inform and educate the patient about the different stages of treatment, their difficulties and know how to manage the expectations from them. A well-prepared documentation and maintaining good relations with the patient, in addition to being fully aware of their responsibilities in the civil sphere are of paramount importance for the dental surgeon, avoiding future complications.

Introdução: Com o avanço da Implantodontia em anos recentes, é possível observar um aumento significativo não apenas no número de pacientes que procuram essa alternativa de tratamento, mas também podemos notar o crescimento de profissionais que se habilitam a executar tais procedimentos. Contudo, a Implantodontia não está livre de complicações e insucessos, fatos que podem originar discussões no âmbito jurídico entre pacientes e esses profissionais especializados. Objetivos: Este artigo visa apresentar algumas das ocorrências que podem levar ao insucesso dos implantes dentários, bem como as possíveis conseqüências legais que podem afetar ao dentista e os conhecimentos necessários ao mesmo para minimizar os danos, materiais e morais, advindos de intercorrências surgidas de tratamentos indevidos ou com insucesso em suas rotinas, por meio de revisão sistemática. Métodos: Para a confecção desta revisão, foram realizadas buscas em diversos sites, entre eles Google Acadêmico, Biblioteca Virtual em Saúde (Bireme), Scientific Electronic Library Online (Scielo), LILACS, BVS (Biblioteca Virtual de Saúde), e PubMED/Medline..Foram selecionados artigos completos, guidelines, protocolos, monografias, teses e dissertações publicados na íntegra, sendo admitidas publicações na língua portuguesa e inglesa. Para as buscas foram utilizadas as palavras-chave: Implante Dentário; Responsabilidade Civil; Legislação Odontológica; Odontologia Legal e Insucessos. Também foram analisadas decisões jurídicas no site JusBrasil, nos sites do Tribunal de Justiça de Minas Gerais e do Rio de Janeiro em segunda instância, utilizando o termo implante dentário. Resultados: Foram identificados 47 processos no TJRJ e 115 processos no TJMG, onde foram observadas absolvições e condenações dos cirurgiões-dentistas, onde a documentação odontológica, composta pelos termos de consentimento, exames complementares e prontuário, se mostrou de importância vital para a decisão dos casos na esfera jurídica. Conclusão: Com base nos dados e informações coletadas, foi possível concluir que a Implantodontia não é uma alternativa de tratamento livre de complicações e falhas, 3 sendo dever do implantodontista de informar e conscientizar devidamente ao paciente sobre as diferentes etapas do tratamento, suas dificuldades e saber manejar as expectativas dos mesmos. Uma documentação bem elaborada e manter boas relações para com o paciente, além de estar plenamente ciente de suas responsabilidades no âmbito civil são de suma importância para o cirurgião-dentista, evitando futuras complicações.
